By accessing the website and/or using the Services, you agree to be bound by these Terms & Conditions. If you do not agree to these terms & conditions, please leave the site and refrain from using any service provided by RAD.
Access to and use of password protected and/or secure areas of the website and/or use of the Services are restricted to Users with accounts only. You may not obtain or attempt to obtain unauthorized access to such parts of this website and/or Services, or to any other protected information, through any means not intentionally made available by us for your specific use.
1. Definition & Interpretation
1.1 Rad is developed, owned, and managed by Blackbox Studios Media Production.
1.2 In these Terms & Conditions,

‘Users’ shall pertain to any legal person who uses the website.
1.3 The Website offers a technological platform to provide Services such as:

Presentation of featured films, short films, documentaries, series, mini-series, music videos, shows, vlogs, songs, singles, albums and EPs

Presentation of live and recorded webinars, movie premieres, festival premieres, festival awarding ceremonies, and shows through its RAD LIVE functionality

An online community known as RAD SHARE where Users can share photos, videos, texts and contact any Users within the website thru CHAT.

Implementation and administration of reward program for partner establishments

Display of classified advertisement from partner establishments

Arrangement of donations from Users and partner establishments to other Users or organizations
2. General use of Services and/or access of the Website
2.1 Guidelines to the use of the Website and/or Services: You agree to comply with any and all the guidelines, notices, operating rules and policies and instructions pertaining to the use of the Services and/or access to the App, as well as any amendments to the aforementioned, issued by us, from time to time. We reserve the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on the Website.
2.2 Restricted activities: You agree and undertake NOT to:

Impersonate any person or entity or to falsely state or otherwise misrepresent you affiliation with any person or entity;

Use the Website or Services for illegal purposes;

2.3 Availability of the Website and Services: We may, from time to time and without giving any reason or prior notice, upgrade, modify, suspend or discontinue the provision of or remove, whether in whole or in part, the Website or any Services and shall not be liable if any such upgrade, modification, suspension or removal prevents you from accessing the Website or any part of the Services.
2.4 Right, but not obligation, to monitor content: We reserve the right, but shall not be obliged to:

2.5 Restrictions: Users who have breached or are in breach of the terms and conditions contained herein and Users who have been permanently or temporarily suspended from use of any of the Services may not use the Services.

To access and/or use the Services only for lawful purposes and in a lawful manner at all times and further agree to conduct any activity relating to the Services in good faith; and

2.7 Partner establishments or Third Party Vendors: You acknowledge that parties other than Rad (i.e. partner establishments, Third Party Vendors or subcontractors) advertise Products or Services in the App. For the avoidance of doubt, each agreement entered into for the sale of a Third Party Vendor’s Products or Services to a User shall be an agreement entered into directly and only between the Third Party Vendor and the User. You further acknowledge that Third Party VEndors may utilize paid services offered by Rad to promote their Products on the Website.
3. Privacy Policy
3.1 At Rad, we take the privacy of your information seriously. We are committed to complying with Republic Act 10173 or the Data Privacy ACt of 2012 and its Implementing Rules and Regulations. By clicking “Sign Up”, “I agree to Rad’s Privacy policy”, “I agree and consent to the collection, use, disclosure, storage and/or processing of my personal data for the purpose stated in, and under the terms of, Rad’s Privacy Policy” or similar statements available at Rad’s registration page, you acknowledge that you have been notified of and understood the terms of this privacy policy and that you have agreed and consented to the collection, use, disclosure and/or processing of your personal data as described under the terms herein.
3.2 During the course of your use of the Website and the provision of the Services, we may collect personal data from you when you create an account with us, which includes but is limited to your full name, address, age, gender, contact number, email address and interests.
3.3 You must only submit personal data which is accurate and not misleading and you must keep it up to date and inform us of any changes to the personal data you have provided to us. We shall have the right to request for documentation to verify the personal data provided by you.

To record thi interaction of the Users and speakers in the webinars, live shows, live premieres; and pay-per-view contents;

When you record any user-generated content which is uploaded on the Website;

To identify visitors on the Website;

To carry out research on our User’s demographics and behavior;

To display your name, username or profile on the Website;

To perform internal operations necessary to provide our Services, including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analysing usage and activity trends;

To send you marketing or promotional materials about our or Third-Party Vendors’ Products and Services from time to time;

To protect the security or integrity of the Services and any facilities or equipment used to make the Services available; and

We may also conduct automated decision-making processes in accordance with any of these purposes.
3.7 You may unsubscribe from receiving marketing information at any time by using the unsubscribe function within the electronic marketing material. We may use your contact information to send newsletters from us and from our related companies.
3.8 You acknowledge and agree that Rad has the right to disclose your personal data to any legal, regulatory, governmental, tax, law enforcement or other authorities or the relevant right owners, if Rad has reasonable grounds to believe that disclosure of your personal data is necessary for the purpose of meeting any obligations, requirements or arrangements, whether voluntary or mandatory, as a result of cooperating with an order, an investigation, and/or a request of any nature by such parties. To the extent permissible by applicable law, you agree not to take any action and/or waive your rights to take any action against Rad for the disclosure of your personal data in these circumstances.

4.3 We will not be responsible for any unauthorised use of the Services on the Website by yourself, users who act on your behalf or any unauthorised users. It is your responsibility to make your own informed decisions about the use of the Services on the Website and take necessary steps to prevent any misuse of the Services on the Website.

The Website may contain links to other websites operated by other parties, such as our business affiliates or merchants. We are not responsible for the practices of websites operated by these other parties. 8. Law & Jurisdiction
These Terms & Conditions shall be governed by, constructed under and enforced in accordance with the laws of the Republic of the Philippines, without regard to any conflict of law provisions.
Any controversies, conflicts, disputes and/or arising our of these Terms & Conditions shall be resolved by arbitration in Manila, Philippines in accordance with the New Civil Code (R.A. 386), the Arbitration Law of 1953 (R.A. 876), and the Alternative Dispute Resolution Act of 2004 (R.A. 9285). The tribunal shall consist of 1 arbitrator whose decision shall be final and binding.
